New York has one of the strongest tenant protection systems in the US. Here's what every Albany renter should know.
Warranty of Habitability
Every residential lease includes an implied warranty of habitability. The landlord must provide: working plumbing and hot water, adequate heating, working electrical system, freedom from pests and mold, working smoke detectors, and secure locks.
Security Deposit Protection
Deposits limited to one month. Return within 14 days with itemized deductions. Must be held in separate interest-bearing account.
Eviction Protection
Landlords cannot evict without court. Self-help evictions are illegal. The process requires: written notice, court petition, hearing, and eviction warrant.
Lease Renewal
For buildings with 4+ units: 30 days notice in the first year, 60 days for 1-2 years, 90 days for 2+ years of tenancy.
Retaliation Protection
It is illegal to retaliate against tenants for exercising their rights: complaints, tenant associations, or rent withholding.
